In the Know - May 2013: This month: Is the Senate immigration bill good for your organization? How the Symposium can help you decide. And a “thank you” to ACIP members.

Last month I wondered whether comprehensive immigration reform might save us from another mad rush toward an H-1B lottery.  After scrutinizing the Senate immigration bill, the answer is that it might but not for the reasons we want.
 
Although the Senate bill increases the H-1B visa cap to a total of 135,000 in the first year, given that approximately 124,000 applications were filed in the first week for Fiscal Year 2014, it is clear that the cap increase alone won’t get us out of a lottery.  The bill does provide many more green cards and a direct path to green cards for STEM students – a great development that will take some people out of the H-1B queue but which is unlikely to be fully operational for several years. The thing that is most likely to impact the cap are the new recruitment, non-displacement and outplacement attestations as well as the enormous new fees imposed on all employers.  My sense is that many employers may just determine that the cost of doing business in the United States is too high.  As Stuart Anderson notes in a new report, this “would represent a serious policy mistake that would shift more work and resources outside the United States and harm the competitiveness of U.S. employers.”  The Senate bill would also impose significant new restrictions on employers’ ability to place L-1B workers at client sites.

White House & Senate Immigration Reform Principles Include Many ACIP-Supported Solutions; Prospects for Real Reform Growing

“Wow!” That was the message I received from one of our members when President Obama announced his immigration reform plan that includes more STEM green cards, cutting red tape for employers by eliminating backlogs, creating a new category of visas for scientists in federal laboratories, equality for all families and an electronic employment verification system. This plan closely mirrors that being put together by a bipartisan group of Senators, but falls short of the Immigration Innovation (“I-Squared”) Act of 2013 (S. 169) which would also increase the H-1B cap.
 
If these outlines look familiar it is because ACIP advocated many of these same ideas during the comprehensive immigration reform debates in 2006-2007, and they are included in our 2013 Principles for Immigration Reform. I’m often asked what is different this time around? My answer is that it certainly “feels” different. There is more energy, more consensus and a greater understanding of the reasons (political, economic and humanitarian) why we need to fix our immigration system.

Happy New Year! I hope you had a relaxing holiday surrounded by family and friends.

The pomp and circumstance of the presidential inauguration is a few weeks away, but today is the changing of the guard in Congress.  Eighty-seven men and women will be sworn-in for the first time.  They face tremendous challenges – the remainder of the fiscal cliff, gun control and immigration are at the top of the list – but like New Year’s resolutions the beginning of a new congress offers the possibility of a fresh start and a chance to get something done.

Has it really been only a month since the election?! Unless you’ve walled yourself off from all media (which is understandable after the endless election), you’ve seen that “comprehensive immigration reform” (CIR) will be front and center in the new Congress. There is no doubt that this reform is critical for U.S. employers and our nation’s continued prosperity, but that’s been clear for over a decade. President Bush and Congress made their most recent and serious attempt at CIR in 2007 and failed. So it’s fair to ask, “What’s different this time around?” I see two parts to this answer: the substance and the politics. Let’s begin with the easy part – the substance.

We hope each of you and your families and friends survived Hurricane Sandy without too much trouble. The winds brought trees and power lines down all around us, but luckily ACIP staff were spared the devastation some of our neighbors received. Our offices were closed for several days, but we are back up and running and looking toward the next big event to sweep the country: the election. Did you watch the debate last night? In Washington, we have parties to watch these. I’ll leave it to the pundits to decide who won and who lost, but I will give you my thoughts on how the debate circled around immigration without ever discussing it. Both candidates spent a great deal of time talking about the need to get the economy growing. Neither mentioned that they both have supported STEM visas as one way to stimulate such growth. The candidates also were asked whether there is too much or too little government regulation. I was waiting for one of them to draw the connection between these issues – to explain how reasonable, consistent and transparent regulations give employers the certainty and confidence to hire today and to plan for their workforces of the future. As we are all too painfully aware, the lack of predictability in our immigration system is a drag on your organization’s ability to get the job done. This damper on productivity ultimately harms all Americans. Perhaps they’ll draw these connections in future debates.

Elephants and donkeys and hurricanes – oh my! ACIP’s first political conventions experience was a whirlwind two weeks that started with Hurricane Isaac and ended with President Obama’s speech. It was so exciting to be in Tampa and Charlotte with so many people who care about making our country great. With a reinvigorated spirit, we’re back in Washington and ready to do our part – especially when it comes to making sure we see follow-through on all of the positive things said about high-skilled immigration reform.
 
At the same time, we’ve been battening the hatches against other rising tides – proposed revisions to the Labor Condition Application (LCA); confusing information about electronic I-94s, the end of DS-2019 stamps and I-9s; implementation of Deferred Action for Childhood Arrivals (DACA); and a wave of upcoming stakeholder engagements.
